General Terms and Conditions (GTC) - "Huesli Holiday Apartments" Landlord: Lukas + Filipa Häsler, Rossmaad 143, 3814 Gsteigwiler

1. Check-In is possible from 4:00 PM on the day of arrival. Check-Out must occur by 10:00 AM on the day of departure at the latest. Exceeding the departure time by more than one hour will result in the charge of an additional night. Different arrival and departure times can be arranged individually with the landlord. If the tenant does not arrive by midnight on the day of arrival, the contract is considered terminated after a grace period of 48 hours without notification to the landlord. The tenant has no right to a refund. The landlord or their representative may then rent out the property freely. No (partial) refund of the rent will be provided for early departures.

2. Additional Services: Bed linen and towels are included in the rental price. Additional services such as cleaning during the stay can be provided upon request and for an additional fee.

3. Internet Use: Wi-Fi is provided free of charge. The tenant agrees not to use the internet access for illegal purposes.

4. A one-time fee will be charged for the final cleaning, which will be invoiced separately. In case of excessive dirtiness, we reserve the right to charge additional cleaning costs.

5. Special Requests and side agreements are generally possible but must be confirmed in writing by the landlord.

6. Payment: The rental agreement becomes valid upon receipt of payment into the landlord's account. The total amount is due immediately upon booking. Non-payment will be considered a cancellation and entitles the landlord to re-rent the property. Costs for water, parking space, and waste are included in the rental price.

7. Cancellation Policy: Full refund for cancellations made at least 14 days before the check-in date. A 50% refund for cancellations made at least 7 days before check-in. No refunds for cancellations made less than 7 days before check-in.

8. Tenant Obligations: The tenant agrees to treat the rented property (holiday home, inventory, and outdoor areas) with care. Any damages occurring during the rental period must be reported to the landlord immediately. The tenant is liable for damages caused by them. Any defects and damages identified upon arrival must also be reported immediately; otherwise, the tenant will be liable. A reasonable period must be given to the landlord to remedy any damages and defects. Claims resulting from complaints not reported immediately are excluded. Complaints made only after the stay are also excluded from compensation. In the event of any disruptions to services, the tenant is obliged to do everything reasonable within their legal obligations to help rectify the disturbance and minimize any resulting damage. On the day of departure, the tenant must remove personal belongings, dispose of household waste in the designated containers, and store dishes clean and washed in the cupboards.

9. Data Protection: The tenant agrees that necessary data about their person will be stored, modified, and/or deleted as part of the contract concluded with them. All personal data will be treated confidentially.

10. Liability: The description of the rental property has been made to the best of our knowledge. The landlord is not liable for influences on the rental property due to force majeure, power and water outages, storms, or unforeseen circumstances such as official orders or sudden construction sites. Natural and local events may lead to disturbances for which no liability is assumed. The landlord will make efforts to assist in problem resolution where possible. The landlord is not liable for the use of provided play and sports equipment. The tenant is responsible for their own travel to and from the property. The landlord is not liable for theft or fire. The tenant is fully liable for willful destruction and damage.

11. Final Provisions: Photos and text on the website or in the flyer serve as a realistic description. A 100% match with the rental property cannot be guaranteed. The landlord reserves the right to make changes to the equipment (e.g., furniture) as long as they are of equivalent quality. Should one or more provisions of these terms and conditions be invalid or become invalid, the validity of the remaining provisions shall not be affected. The invalid provision will be replaced by a valid provision that comes closest to the economic and legal intention of the parties. Swiss law applies. The place of jurisdiction and performance is the residence of the landlord.
